The Supreme Administrative Court stated in decisions KHO 2016:193 and KHO 2016:194 that it is possible to return asylum seekers to Baghdad. The titles are almost identical but the decision KHO 2016:193 was that the applicant can be returned and the decision KHO 2016:194 that the applicant can not be returned.

The security situation in Baghdad has on the basis of the last reports weakened. Arbitrary violence, however, was not as such be considered to cause a serious and individual threat to anyone residing in the territory. Nor shall sunni muslims considered alone on the basis of religious identity to be in such danger that they could not be returned.

Due weight must be given and a person to be considered to be in a vulnerable position, for example if the applant is a single woman or a single parent or without a family or fallen outside the tribe. Also other personal circumstanses of the appelant as in the decision KHO 2016:194 can lead to the fact that the applicant can not be returned.
